Introduction to the User Agreement

Our online store welcomes you and informs you that you will find below the terms and conditions governing your use of this store, as well as all the legal effects resulting from your use of the store's services on the World Wide Web through this electronic platform. Any person’s use of the store, whether as a consumer of the store's service or product or otherwise, constitutes their full legal capacity, consent, and acceptance of all articles and provisions of this agreement. It is a confirmation of your commitment to its regulations and what is stated therein. This agreement applies to all types of transactions between the consumer and the store. This agreement is considered effective and binding upon your approval and initiation of registration in the store, pursuant to Article 10 of the Saudi Electronic Transactions Law.

Article 1 - Introduction and Definitions

The above preamble is an integral part of this agreement. Below you will find the indications and definitions of the main terms used in this agreement:

1. (The Store): This definition includes all forms of the store on the World Wide Web, whether it is an electronic application, a website on the internet, or a commercial shop belonging to (TOP SUMMIT).
2. (The Consumer): The person who engages in electronic commerce with the desire to obtain the products or services provided by the store through its electronic platform.
3. (The Agreement): This term refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.

Article 2 - Legal Capacity of the Consumer

1. The consumer acknowledges that they have the legal capacity considered under Sharia and the regulations to transact with the store, or that they are at least eighteen years of age.
2. The consumer agrees that in the event of violating this article, they shall bear the consequences of this violation before third parties.

Article 3 - Nature of the Obligation

1. The store's obligation toward consumers is to provide the (service or product).
2. The store may provide other services, such as after-sales services or other related services, depending on the nature and type of (service or product) requested by the consumer.

Article 4 - Controls for Using the Store

1. The consumer undertakes to use the store's electronic platform in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.
2. The consumer undertakes, when purchasing a service or product from this store, not to use this service or product in a way that violates public morals and the regulations in force in the Kingdom of Saudi Arabia.

Article 5 - Accounts and Registration Obligations

Immediately upon applying to join this store as a user, you are obligated to disclose specific information and choose a secret username and password to use when accessing the store's services. By doing so, you have agreed to:

1. Be responsible for maintaining the confidentiality of your account information and password, and consequently agree to immediately notify this store of any unauthorized use of your account information or any other breach of your confidential information.
2. The store shall not, under any circumstances, be liable for any direct or indirect, moral or material loss that may befall you as a result of exposing the username or password information.
3. You undertake to use your account or membership with the store yourself, as you are fully responsible for it. In the event that someone else uses it, this constitutes a presumption that you have authorized them to use the store in your name and for your account.
4. You undertake to use the store with complete seriousness and credibility.
5. You undertake to disclose true, correct, updated, complete, and legal information about yourself as required during registration with the store, and you undertake to update your data if it changes in reality or when necessary.
6. Our store undertakes to handle your personal information and contact addresses with strict confidentiality.
7. If it becomes apparent to the store that you have disclosed information that is untrue, incorrect, outdated, incomplete, illegal, or in violation of what is stated in the user agreement, the store has the right to suspend, freeze, or cancel your membership and account on the platform, without prejudice to the store's other rights and legitimate means to recover its rights and protect other consumers.
8. In the event of non-compliance with any of the above, the store management has the right to suspend or cancel your membership or block you from accessing the store's services again.

Article 6 - Electronic Communications and Official Means of Communication

1. The parties to this agreement agree that communication shall be via email or the official channels registered on the platform.
2. The consumer agrees that all agreements, announcements, statements, and other communications provided electronically take the place of their written counterparts and serve as a standalone proof in meeting regulatory and legal requirements.
3. The consumer agrees to the possibility of communicating with them and notifying them of any provisions regarding this agreement or regarding their transactions through the store management broadcasting general messages sent to all consumers or to specific users of the store.

Article 7 - Amendments to the User Agreement and Fees

1. In the event that any article or clause contained in this agreement is canceled or is no longer effective, such an event does not invalidate the validity of the remaining articles, clauses, rules, and provisions contained in this agreement, which shall remain in effect until further notice from the store management.
2. This agreement—which is amended from time to time as circumstances require—constitutes the working mechanism, understanding, and agreement between (the consumer) and (the store).
3. The store may impose fees on some consumers, depending on the offers, products, or services they request, or any fees or taxes imposed by the State on the nature of the product or service.
4. The store reserves the right to add, increase, reduce, or deduct any fees or expenses under the articles, clauses, and provisions of the User Agreement from any of the consumers, regardless of the reason for their registration.

Article 8 - Payment and Settlement Services in the Store

1. Through its partners, the store provides a payment and settlement system. Payment can be made entirely online through the payment options available on the store (Mada, Apple Pay, Visa) or through any payment method provided by the store from time to time.
2. The store undertakes to determine the price of the service or product displayed in its store according to the recognized market value.
3. The store undertakes to provide invoices, receipt vouchers, and delivery slips for all amounts arising in its store, and undertakes to give the consumer an invoice for their purchase of a service or product.
4. The store undertakes to provide the recognized accounting standards in its online store, in application of the provisions of this agreement, and for the legal, economic, commercial, and organizational interests this regulation holds.

Article 9 - Intellectual Property

1. The intellectual property rights of the store are fully owned by the store, whether owned by them before or after the establishment of this electronic platform.
2. The consumer respects the intellectual property rights of the store, which include the store name itself (TOP SUMMIT), and other words, logos, and symbols belonging to the store or displayed on it, as every right associated with the store name is a full intellectual property right owned by the store.

Article 10 - Liability of the Store

1. The store undertakes to conduct its business through this electronic platform in a regulatory manner and in accordance with the systems in force in the Kingdom of Saudi Arabia, and according to the provisions of this agreement.
2. The store shall not bear any claims arising from errors or negligence, whether resulting directly, indirectly, accidentally, by the consumer, or by a third party such as shipping companies.
3. TOP SUMMIT store, its employees, owners, and representatives undertake that the (product or service) is safe, legitimate, and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia and is used for legitimate purposes.

Article 11 - Restriction of Access or Membership

The store may suspend or cancel the consumer's membership or restrict the consumer's access to the platform's services at any time, without notice, for any reason, and without limitation.

Article 12 - Applicable Law and Regulations

This User Agreement is governed, formulated, and interpreted in accordance with the laws, regulations, and legislation in force and applicable in the Kingdom of Saudi Arabia, and is fully and completely subject to the regulations in force under the authorities in the Kingdom of Saudi Arabia.

Article 13 - General Provisions

In the event that any article or clause contained in this User Agreement is canceled or is no longer effective, such an event does not invalidate the validity of the remaining articles, clauses, and provisions contained in the User Agreement, which shall remain in effect until further notice from the store management.

This User Agreement—which may be amended from time to time as circumstances require—constitutes the entire user agreement, working mechanism, understanding, agreement, and contract between the store and the consumer. Both parties to this agreement also agree to take the following into consideration:

1. The Arabic language is the applicable language when interpreting the provisions of this agreement or when translating it into another language.
2. All prices displayed on the store's services or products may be modified from time to time.
3. Promotional or marketing offers that the store may place are temporary offers, and the store has the right to modify or stop these promotional or marketing offers at any time.
4. The parties to this agreement undertake to deal with each other in a manner that does not violate Sharia rules and the relevant rules, regulations, and laws related to the nature of transactions between the store and the consumer.
5. This User Agreement shall not be canceled except by a decision issued by the management of TOP SUMMIT store.
